Concho Valley covenants

What these cover

This page covers Concho Valley Units 6 and 8. The two sets of covenants are materially identical. Unit 8 was recorded on February 24, 1972 as document 1972-066386. Unit 6 was recorded on February 16, 1971 as document 1971-061602. Both were recorded by Transamerica Title Insurance Company of Arizona, as Trustee.

The rules in plain terms

• Homes must be single-family and newly built, with at least 800 square feet of ground-floor living area.
• New manufactured homes are allowed. A used or moved-in home from another location is not. Every structure must be new construction on a concrete foundation, with hardwood or concrete floors.
• Travel trailers and campers are allowed only while a home or cabin is being built. There is no general camping, and no shed, tent, garage, or other temporary structure may be used as a place to live.
• Homes must sit back at least 20 feet from the front and rear lot lines and 8 feet from each side, and stand no taller than 35 feet.
• Once building starts, the home must be finished within 12 months.
• Utility easements run along the lot lines, 20 feet wide, 10 feet on each side.
• There is no homeowners association, no dues, and no architectural committee.

Who enforces them

Apache County does not enforce private covenants. In the county's own words, these are private agreements that are not enforceable by the county. Enforcement rests with the property owners. Any owner of land in the same unit may ask a court to enforce the covenants. No association is involved.

The covenants remain on file and in effect. Unit 8's current term runs through January 1, 2032, and Unit 6's through January 1, 2031, and both renew automatically. Changing them takes a written vote of at least two-thirds of the owners.
